Pregnant For Years?

Exactly how long can a woman be pregnant in Islam? From Islamqa:


مسألة " أطول مدة لحمل المرأة " من مسائل الخلاف بين علماء الشرع ، وهي ضيقة الخلاف عند الأطباء ، وأضيق منها في قوانين الأحوال الشخصية في غالب العالم العربي .


أما عند علماء الشرع : فقد اختلفوا في أقصى مدة تمكثها المرأة وهي حامل إلى أقوال :


1. أقصى مدة للحمل : هي المدة المعهودة ، وهي تسـعة أشـهر، وبه قال أصحاب المذهب الظاهري .


2. أقصى مدة للحمل : سنَة واحدة ، وهو قول محمد بن عبد الحكم ، واختاره ابن رشد .


3. سنتان ، وهو مذهب الحنفية .


4. ثلاث سنين ، وهو قول الليث بن سعد .


4. أربع سنين ، وهو مذهب الشافعية ، والحنابلة ، وأشهر القولين عند المالكية .


5. خمس سنين ، وهي رواية عن الإمام مالك .


6. ست سنين ، وهي رواية عن الزهري ، ومالك .


7. سبع سنين ، وبه قال ربيعة الرأي ، وهي رواية أخرى عن الزهري ، ومالك .


8. لا حد لأكثر الحمل ، وهو قول أبي عبيد ، والشوكاني ، وقال به من المعاصرين : المشايخ : الشنقيطي ، وابن باز ، والعثيمين . https://bit.ly/3ExjuDR


Translation: The issue of “the longest period of a woman’s pregnancy” is one of the issues of disagreement among scholars of Sharia, and it is narrow of disagreement among doctors, and narrower than it in personal circumstance laws in most of the Arab world.


As for scholars of Sharia: they differed as to the maximum period that a woman could remain pregnant:


1. The maximum period of pregnancy: it is the usual period, which is nine months, and that is what the adherents of the Zahiri school have said.


2. The maximum period of pregnancy: one year, which is the view of Muhammad ibn Abd al-Hakam, and which Ibn Rushd chose.


3. Two years, which is the Hanafi school.


4. Three years, which is the view of Al-Layth b. Sa’d.


4. Four years, which is the Shafi’i and Hanbali school, and the most popular of the two views among the Maliki.


5. Five years, which is a narration from Imam Malik.


6. Six years, which is a narration from Al-Zuhri and Malik.


7. Seven years, and that is what Rabi’ah al-Ra’i said, which is another narration from Al-Zuhri and Malik.


8. There is no limit to most pregnancy, which is the view of Abu Ubaid and Al-Shawkani, and that is what some of the contemporaries said: The sheikhs: Al-Shanqiti, Ibn Baz and Al-Uthaymin.
